These Terms of Use (“Terms”) govern your access to and use of the Dynition website at dynition.ai (the “Site”), operated by Dynition, Inc. (“Dynition,” “we,” or “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms cover the website and our marketing materials only. Use of the Dynition product, once it becomes available, is governed by a separate Customer Agreement.

1. Using the Site

You may use the Site for lawful purposes only. You agree not to:

  • break the law or infringe anyone's rights;
  • access, disrupt, or probe the Site or its systems without authorization;
  • scrape, harvest, or collect data in a way that burdens the Site or misuses other people's information;
  • introduce malware or interfere with the Site's operation; or
  • misrepresent your identity or misuse any access we grant you.

We may suspend or terminate access if you violate these Terms.

2. Partner portal

The design-partner portal is available to invited partners only. Sign-in links are personal, time-limited, and single-use; keep yours confidential and do not share access. You are responsible for activity under your access. We may modify, suspend, or revoke access at our discretion.

3. Intellectual property

The Site and its content — including text, graphics, logos, and downloadable materials such as whitepapers — are owned by Dynition or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to view the Site and to use our whitepapers for your own internal, non-commercial reference. All other rights are reserved; the Dynition name and logo may not be used without our permission.

4. Whitepapers and other content

Information on the Site and in our whitepapers is provided for general informational purposes. It is not legal, financial, or other professional advice, and you should not rely on it as such.

5. No warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

6. Limitation of liability

To the fullest extent permitted by law, Dynition will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100).

7. Third-party links

The Site may link to third-party websites we do not control. We are not responsible for their content or practices, and your use of them is at your own risk.

8. Changes

We may update the Site or these Terms at any time. Changes take effect when posted, and we will revise the “Last updated” date above. Your continued use of the Site means you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located there for any dispute relating to the Site or these Terms.
